1. Agreement to Terms

Welcome to PropertiesJet. These Terms and Conditions ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and PropertiesJet ("we," "us," or "our"), concerning your access to and use of the PropertiesJet.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site" or "Services").

By accessing or using the Site, you agree that you have read, understood, and agree to be bound by all of these Terms. **If you do not agree with all of these Terms, then you are expressly prohibited from using the Site and you must discontinue use immediately.**

2. Description of Service

PropertiesJet is an online platform that connects property seekers with property owners, agents, and developers. Our services allow users to create and manage accounts, publish property listings for sale or rent, search for properties, and communicate with other users through our integrated messaging system. All listings are subject to review and approval by our administrators.

3. User Accounts and Responsibilities

To access certain features of the Site, you must register for an account. You agree to:

• Provide accurate, current, and complete information during the registration process.
• Maintain the security of your password and identification. You are responsible for all activities that occur under your account.
• Notify us immediately of any unauthorized use of your account.
• Be at least 18 years of age to create an account.

4. User-Generated Content

You are solely responsible for all content, including property listings, images, videos, profile information, and messages, that you post, upload, or otherwise make available through the Services ("User Content").

By providing User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform your User Content in connection with the Services.

You represent and warrant that:

• You own or have the necessary licenses, rights, consents, and permissions to publish the User Content you submit.
• Your User Content does not infringe upon any third party's rights, including copyright, trademark, privacy, or other personal or proprietary rights.
• Your User Content does not contain any false, inaccurate, misleading, or fraudulent information.

We reserve the right, but are not obligated, to review, reject, or remove any User Content at our sole discretion, particularly listings that do not meet our quality standards or violate these Terms.

5. Prohibited Activities

You agree not to use the Site for any of the following prohibited activities:

• Engaging in any criminal or tortious activity, including fraud, spamming, copyright infringement, or theft of trade secrets.
• Posting any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• Using the Site to advertise or solicit any goods or services for commercial purposes other than the listing of real estate as intended by the platform.
• Impersonating another user or person.
• Using any information obtained from the Site to harass, abuse, or harm another person.
• Attempting to bypass any measures of the Site designed to prevent or restrict access to the Site, or any portion of the Site.

6. Intellectual Property Rights

All content on the Site, including the text, software, scripts, graphics, photos, sounds, music, videos, and interactive features ("Site Content") and the trademarks, service marks, and logos contained therein ("Marks"), are owned by or licensed to PropertiesJet, subject to copyright and other intellectual property rights under Nigerian and foreign laws. User Content remains the intellectual property of the respective users.

7. Disclaimer of Warranties and Limitation of Liability

PropertiesJet is a platform. We are not a real estate agency and do not own, sell, rent, or manage any of the properties listed on the Site.

The Site and Services are provided on an "as-is" and "as-available" basis. You agree that your use of the Site and our services will be at your sole risk. To the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with the Site and your use thereof, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We make no warranties or representations about the accuracy or completeness of the Site's content or the content of any websites linked to the Site and we will assume no liability or responsibility for any:

1. Errors, mistakes, or inaccuracies of content and materials provided by users.
2. Personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our Site.
3. Any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.
4. Any interruption or cessation of transmission to or from the Site.
5. Any bugs, viruses, Trojan horses, or the like which may be transmitted to or through the Site by any third party.
6. Any financial loss or damages incurred as a result of any transaction or agreement made between users of the Site.

You are solely responsible for all of your communications and interactions with other users of the Site. You understand that we do not make any attempt to verify the statements of users or to review or visit any properties. As such, you are solely responsible for carrying out all necessary due diligence and physical verification for any property before making a payment.

8. Indemnification

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) your User Content; (2) your use of the Services; (3) your breach of these Terms; or (4) your violation of the rights of a third party, including but not limited to intellectual property rights.

9. Termination

We reserve the right to, in our sole discretion and without notice or liability, deny access to and use of the Site (including blocking certain IP addresses) to any person for any reason, including without limitation for breach of any representation, warranty, or covenant contained in these Terms or of any applicable law or regulation. We may terminate your use or participation in the Site or delete your account and any content or information that you posted at any time, without warning, in our sole discretion.

10. Governing Law

These Terms and your use of the Site are governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law principles.

11. Changes to Terms

We reserve the right to change, modify, or revise these Terms at any time. Any changes will be effective immediately upon posting the revised version on the Site. Your continued use of the Site after the date such revised Terms are posted will constitute your acceptance of the changes.
